TERMS & CONDITIONS
1. INTERPRETATION
1.1 The definitions and rules of interpretation in this condition apply in these terms and conditions.
Centre: the Beauty School at 28 Sangley Road, Catford, London SE6 2JH.
Student: you, the Student in respect of whom the course Services are to be provided.
Online Course: the delivery by us or professional bodies of an online course pursuant to which you learn course materials remotely.
Practical/Taught Course: the delivery of interactive face-to-face taught sessions/classs/courses delivered on site at Y.O.U.R Beauty School.
Contract: the agreement between You and Y.O.U.R Beauty School in terms of which Y.O.U.R Beauty School has agreed that you can attend the number of Sessions stated on this document, or otherwise agreed between You and Y.O.U.R Beauty School.
Conditions: these terms and conditions of business.
Customer: you, the Student purchasing the course Services.
The Fees and services Schedule: the fee schedule attached to these terms and conditions, which You agree may be amended by Y.O.U.R Beauty School.
Y.O.U.R Beauty School: Y.O.U.R Beauty School Limited, a company incorporated in England and Wales under Company number 11310920 and whose registered address is 28 Sangley Road, Catford, London SE6 2JL.
Y.O.U.R Beauty School Equipment: the facilities and equipment provided by Y.O.U.R Beauty School in connection with the supply of Services.
Refundable Deposit: All deposits requested are to be securely held by Y.O.U.R Beauty School described in the Fees and Services Schedule.
Services: the courses provided by Y.O.U.R Beauty School on the terms of this agreement.
Promotions: Special discounted offer, money off offers, vouchers and voucher codes.
1.2 Headings in these conditions shall not affect their interpretation.
1.3 A reference to writing or written includes faxes but not e-mail.
2. APPLICATION OF CONDITIONS
2.1 These Conditions shall apply to and be incorporated into the Contract.
3. COMMENCEMENT AND DURATION
3.1 The Services supplied under the Contract will be provided by Y.O.U.R Beauty School from the start date and will continue until the course completion
4. Fees
4.1 Practical and online course fees must be paid at least 14 days day before the start date of your chosen course(s).
4.2 The Fees for the practical and online courses are displayed on the YBS website or told to you over the telephone or in person at the time you place your order for them.
4.3 Unless otherwise specified at the time you purchase the Services/Course, the Fees are inclusive of VAT or other local taxes.
4.4 Any additional costs in relation to Course Kits, Uniforms and any other specified costs payable in respect of the delivery of the Service to you will be set out in the Website or told to you over the telephone or in person prior to your purchase of the Services.
4.5 Course fees do not include additional fees payable to professional bodies such as The Beauty Guild or VTCT. Additional fees are payable directly to these organisations, failure to pay required amounts directly is entirely the responsibility of you the student. YBS is not responsible or liable. Failure to make direct payment can result in the termination or suspension of your course enrolment.
4.6 Fees for the course selected by you via the YBS website, in person or purchased over the telephone shall be debited from your credit / debit card or paid in cash at the time of purchase. As per 4.1 fees must be paid in full at least 14 days prior to your assign course start date or accessing any online course.
4.7 Any fees charged by your debit or credit card provider in connection with your purchase of courses are for your own account and Y.O.U.R Beauty School (YBS) shall not be responsible for these.

4.8 You shall be responsible for all costs you incur in connection with your attendance at any practical courses or your access onto any online course.

4.9 Without Prejudice to any other right or remedy that it may have, if the Customer fails to pay Y.O.U.R Beauty School on the due date, Y.O.U.R Beauty School may:
a) Charge interest for every day after the due date, or a penalty fee;
b) Suspend all Services until payment is made in full;
4.10 YBS reserve the right amend/changes course prices at anytime without notification, this includes promotional and or special discounted offers on course fees.

4.11 Promotional and or special discounted offers are subject to availability. Y.O.U.R Beauty School reserve the right to withdraw and/or amend such offers at anytime.

4.12 YBS vouchers or money off codes can not be used in conjunctions with any other offers.
​
4.13 All promotional offers are subject to YBS terms and conditions.
5. REFUNDS
5.1 Course related fees and/or deposits can only be refunded in full if a course is cancelled by Y.O.U.R Beauty School. Full fees and/or deposits for tuition fees, kits or examinations cannot be refunded in the case of illness, personal problems, relocation, change of work, lack of visa or any other reason that may mean you have to cancel or leave your course.

5.2 A 14 day cooling off period is available on selected short courses, please contact us for details.
6. Y.O.U.R BEAUTY SCHOOL’S OBLIGATION
6.1 Y.O.U.R Beauty School will provide the services for students. However, the student acknowledges that there may be times when the service cannot be provided. Examples of these occasions are when insufficient staff members of Y.O.U.R Beauty School due to adverse weather condition or the centre must be close for health and safety reasons. Where these circumstances occur, the student will not be entitled to cancel the agreement. Y.O.U.R Beauty School will use all reasonable endeavours to minimise such disruption to the Services, which are beyond its reasonable control.
6.2 The health and safety of our students is paramount at Y.O.U.R Beauty School. Accordingly Y.O.U.R Beauty School will use all reasonable endeavours to observe all health and safety rules and regulations, and to implement such reasonable security requirements that apply at the centre in respect of the student from time to time.
7. STUDENT'S OBLIGATIONS
7.1 The student's shall:
a) co-operate with Y.O.U.R Beauty School in all matters relating to the that of awarding professional bodies
b) students must be present and arrive at the specified time assigned to begin class for each session
c) maintain at least an 85% attendance to the centre and class
d) provide Y.O.U.R Beauty School with all relevant contact details (for emergencies, such as illness)
7.2 If Y.O.U.R Beauty Schools’ performance of its obligations under this contract is prevented or delayed by any act of omission of the student, Y.O.U.R Beauty School shall not be liable for any costs, charges or losses sustained or incurred by the student arising directly or indirectly from such prevention or delay.
7.3 The student will be liable to pay Y.O.U.R Beauty School, on demand, all reasonable costs, charges or losses sustained or incurred by Y.O.U.R Beauty School arising directly or indirectly from the student’s fraud, negligence failure to delay in the performance of any of its obligations under the contract.

7.4 Without prejudice to any other right or remedy that it may have, if the students fails to pay Y.O.U.R Beauty School on the due date, Y.O.U.R Beauty School may:
a) Charge interest for every day after the due date, or a penalty fee;
b) Suspend all services until payment is made in full;
c) terminate the student's enrolment contract
7.5 Time for payment is the essence of the contract.

7.6 All sums payable to Y.O.U.R Beauty School under the contract shall become due immediately on its termination, despite any other provision.
8. CHANGES TO YOUR COURSE
Withdrawal of a course before starting the course.
8.1. Y.O.U.R Beauty School (YBS) will use all reasonable endeavours to deliver all programmes as described on the school website. However, if there are not sufficient enrolments to make a practical/taught course or online course viable, the school may be forced to cancel the course. If you have received an offer for any course or have ordered/purchased any course, the school will notify you as soon as possible and will use reasonable endeavours to provide a suitable replacement course for which you are qualified to undertake. If you do not wish to take up the replacement course or if there is no replacement course, you may cancel the offer/purchase of the course without any liability for fees.
10. TERMINATION
10.1 Without prejudice any other rights or remedies which the parties may have, Y.O.U.R Beauty School may immediately terminate the contract without liability to the student if:
a) are intoxicated through alcohol or illegal drugs while on our premises;
b) damage our property or the property of our employees or other students attending our premises;
c) fail to pay when due your Fees;
d) damage our property or the property of our employees or other students attending our premises;
e) act in an aggressive, bullying, offensive, threatening or harassing manner towards any employee of Y.O.U.R Beauty School, any teacher or lecturer who provides the taught courses or any student who attends any taught course;
f) are in breach of these terms and conditions.
11. PRIVACY POLICY
This privacy policy sets out how Y.O.U.R Beauty School use and protect the personal information provide when you use this website.
11.1 Y.O.U.R Beauty School is committed to ensuring that your privacy is protected. Sections of our website will require you to provide specific personal information by which you can be identified when using this website, you can be assured that it will only be used in accordance with this privacy statement.

a) online registration forms, applications forms, customer portal/login areas and social media registration
b) directly. You may give us your identity, contact and financial data by filling in forms or by corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you; apply for our products or services, including taught courses, both in person and online, create an account on our website, via our student/customer portal, subscribe to our service or publications, newsletters and social media news, requested marketing to be sent to you.
11.4 How we use your personal data? We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances to aid in the assessment of assigning customers/students a course, on-going course recording and assessment, application history, enrol customers/students onto a course, direct marketing, communicate course material and general course/school related communication.

12. FORCE MAJEURE
Y.O.U.R Beauty School shall have no liability to the student under the contract if it is prevented from performing its services under the contract by acts omissions or accidents beyond its reasonable control including (but without limitation) industrial disputes, failure of utility services or transport networks, acts of God, war, riots, malicious damage, breakdown of plant material or default of suppliers or subcontractors.
13. VARIATION
13.1 Y.O.U.R Beauty School may, from time to time, and without notice, change the services in order to comply with any applicable safety or statutory requirements.

13.2 Y.O.U.R Beauty School may supplement these terms and conditions from time to time by adding such rules and terms as may be reasonable from time to time.
